Far as I know everything should be alright, I need to personally talk to my Mom about things but for now. No one should take things personally including you HMS you were the one that keeps these adorable little balls of fur in our lives and I thank you for that.

Whaaaaaaat?

I'm sorry, I'm incredibly confused. What exactly is illegal about my business/payment method??? I ALWAYS tell people to send their payments properly, and not mark them as gifts. (A common practice among less honest artists trying to avoid paying paypal's fees)

I currently am working as a freelance artist, creating one of a kind items as fast as I am physically able to within the hours I can put in each day between taking care of our household and my infant daughter. I have always been up front and honest about the wait time for this winter breeding season being At LEAST 2-3 months. This isn't because I want anyone to have to wait, its because I can only make things so fast! I only have two hands, and being a living human being, can only sculpt for so long each day before those hands get tired, and hurt.

I find it funny that I'm suddenly, out of nowhere, after multiple convention seasons of no complaints, getting people trash talking about me or complaining about me "scamming" them when I have NEVER yet failed to deliver paid for item to a commissioner. I am behind schedule more often than I would like, but such is the way of things when one is a mother and caring for a baby. :/

I honestly can't help but wonder where the sudden venom is coming from, and why???

If you are THAT unhappy with the wait, tell me and I will refund you, minus the deposit. I quite frankly am not interested in having commissioners unhappy and feeling they are being "illegally" cheated. :(

I am going to second some of what HMS is saying here.

First and foremost, we told /everyone/ up front that there would be a 2-3 month MINIMUM wait.
We told you that if you were not able to be patient and wait for your purchases, NOT to purchase any Wyrms.

Apparently, people ignored this.

If your parents are concerned about you receiving your item, they are welcome to contact HMS directly and inquire about their purchases.
HOWEVER, this is NOT going to make your purchase jump the queue.
Other people are waiting patiently.

If you are not satisfied, you may request a refund minus the cost of the non-refundable deposit (this was mentioned in the how-to when you ordered your Wyrms).

We encourage responsible buyers who communicate with us when there are issues.
This sort of thing is really not appropriate.

Just to clarify something for folks and something I'd been pondering bringing up, while not ILLEGAL per se since people are welcome to give HM money for whatever they feel like, it may technically be in violation of Paypal's TOS. The Paypal buyer protection can only be filed for within something like 45 days, unless they extended it to 90 since the last time I read up on things. Beyond that, consumers are on their own as far as getting their items or refunds. I hadn't gotten to read through Paypal's rules but I recall eBay (which owns Paypal) had/has some sort of rule against listing preorders for items more than 30 days in advance, too.

I'm perfectly happy to wait, but I can understand why some people who are new to this might be gunshy. :p it might be more hassle than it's worth but I wonder if it would help to offer something like...forty days in, send a second payment, get your first payment refunded? kind of thing, that way the Paypal buyer protection would still be in effect and there wouldn't be the pressure of that tight of a deadline.

Smoke, I think you should remind your mother this: HM is not a shop, she's a person. She doesnt have a stock of wyrms ready to be shipped any moment, and she is a subject for any person's problems, like falling ill, having family things to attend to, etc. I dont think it's right to think about her as a shop which is subject to do this and this in certain time - because she's not a shop, she's one person.
A toy shop's laws are not exactly correct for one person's art crafts. Artisian crafts arent factory toys; they all differ in time they require to make, unlike toys that are all stamped within same 2-3 seconds. And because crafts are not toys, which are just ordered off a factory and can be cancelled any time, you cannot ask for a 100% refund any time you like - you will always get back less, because some supplies for your order were already bought.

There are 18 handlers in priority 2, complex. You are part of group 3-as is my friend who put down a disposit and will pay the rest upon completion of the wyrm. We've all been waiting and as far as I know we've all had no problem with this. Because we knew the winter season was HUGE. This is why there are going to be only 2 breeding seasons a year. More handlers a bigger community.

I'm also the owner of several Asian ball jointed dolls, those dolls in many cases are hand made and hand painted-assembled upon ordering and I've waited a month to 3 months for them to ship. And these are larger companies cranking out hand made items that cost anywhere from 200$ to over a thousand. Not to mention there's a language barrier! English vs Korean -Japanese.

When you commision, yes commision. Custom made art peices, the rules are very different from say walking into toys r us. People who order custom made fur suits wait for a long time, custom cars, houses!, jewelry, anything that is part of a mass custom ordering queue. Is going to have a wait. We where all informed of the wait, we are kept to date on delays and issues. There is nothing illegal.

There are currently Kickstarter campaigns in which a reward is a finished MOVIE. And yes it states you won't get it for a few months. So each of us who support those campaigns are aware we won't get our DVD or blu ray for a year go into it fully aware.

Aside from the winter wyrm breeding, she also has other commisions - which where made and aggreeded upon before the winter orders took place, hey we're waiting too! (And some of those commisions have compleation date time tables) And we don't mind. You can't rush these things! She's assured us they'll be done before summer breeding season.

Side note/ I went to PayPal and pulled these quotes,

"If the payment is for pre-ordered or made-to-order goods, shipment is required within the timeframe specified in your item listing. Otherwise, it is recommended that you ship all items within 7 Days after receipt of payment."

I'm personally not the one who is upset about this my mom is just to clear anything up. I'm sure she just got things confused, nothing was to be put towards HMS personally. I will happily be waiting to get my wyrm any day now my Mom of course just needs to learn some patience.

She probally just screwed everything up and forgot that HMS has a life a kid and limited time before her hands cannot sculpt anymore for the day.

While I understand that this is not you personally.
I want you and your mother to understand that there is a proper way of going about things like this.

If you commission an artist online, regardless of who they are or for what sort of product...
You go to the artist first if you have concerns, and you contact them.

Accusing an artist of doing something illegal (it isn't), or pulling payment/filing disputes without even contacting the artist about your concerns...
It's just not okay.

I'll have to tell her personally(my mom) if I can get the guts to. But for now I think this question is resolved and needs no more assistance in the matter and we should get back to the happier life of wyrms ^^.
